Non-profit sues 10 insurers for inadequate flood response

A non-profit organization has filed a lawsuit against several insurers for damages pegged at $20 million, as well as other punitive costs.

Foothills Foundation, a non-profit organization that advocates for safe and affordable housing, has filed a $20 million lawsuit on behalf of four senior and assisted living facilities located in High River and Black Diamond, Alberta, CBC News reports.
 
The suit alleges that 10 insurance companies did not adequately respond to claims filed after the 2013 floods, despite a discovery period indicated that the properties were “severely damaged or destroyed.”
 
A statement of claim filed in Calgary lists the 10 insurers as:
 
  • AMSC Insurance Services
  • Alberta Municipal Insurance Exchange
  • Catlin Canada
  • Northbridge Insurance
  • Northbridge General Insurance
  • Temple Insurance
  • Lombard General Insurance
  • ACE INA Insurance
  • AIG Insurance (aka. Chartis Insurance)
  • BFL Canada
 
The foundation claims that these insurers were obligated to provide compensation for “remediation and or replacement of equipment, personal property and/or damage to structures or dwellings on the properties.”
 
“Despite the claim made by the plaintiff (for coverage) and ongoing and repeated requests by the plaintiff, the insurers have breached the terms of the policies,” its claim reads.
 
In addition to $20 million in damages, the suit seeks other “unnamed punitive costs.”
 
The Foothills Foundation says its mission is to create “safe and affordable housing opportunities and services, not provided by the marketplace, in rural and urban communities.”
